Steve's Computer & Web Service, LLC Computer, Printer and Network Repair Terms of Service

ACKNOWLEDMENT AND ACCEPTANCE ON TERMS OF SERVICE


The Customer requests and authorizes Steve's Computer & Web Service, LLC and any employee, subcontractor or consultant of Steve's Computer & Web Service, LLC, to examine, modify and attempt to repair any and all problems found with the computer system, data storage device, ALL files, and any peripherals left by The Customer on the premises of The Customer or the location of Steve’s Computer & Web Service, LLC.

REPAIR AND SERVICES PRICES ON LOCAL ON SITE REPAIR/SERVICE AND PICK UP

An hourly fee for all Computer, Printer, and Network System repair/service will be posted on the Website and on the Service Order Form.

Billing for Repair and Services include Labor and travel time to the Customer’s Site. If the initial repair and service cannot be completed at the customer’s site. Travel Time maybe waived for the customer, if Steve's Computer & Web Service, LLC needs to come back to finish the repair/service or bring the repaired system back to the customer.

The hourly fee for Computer, Printer, and Network System repair/services does not include any hardware and software costs.  The hardware and software to repair the system will be added to the hourly fees and noted on the final Service Invoice.  

BEFORE THE EXAMINATION OF THE COMPUTER, PRINTER, OR NETWORK SYSTEM

The Customer is aware that the original estimate for repair/service and completion time may change, based on the initial customer’s information provided to Steve's Computer & Web Service, LLC and any employee, subcontractor or consultant of Steve's Computer & Web Service, LLC.


REVISED COMPUTER, PRINTER, OR NETWORK SYSTEM ESTIMATES
During Computer, Printer, or Network repair and/or service, Customer will be contacted with a revised Estimate of repair/service and completion time, before the additional repairs/services are performed. 

TERMINATION OF COMPUTER, PRINTER, OR NETWORK SYSTEM SERVICES

During the repair/services of the computer, printer, or network system, if the revised repair/services estimates, are not accepted by the customer to complete the Repair and/or Service, Steve's Computer & Web Service, LLC and any employee, subcontractor or consultant of STEVE'S COMPUTER & WEB SERVICE, LLC MAY RETURN THE CUSTOMER’S COMPUTER, PRINTER, AND/OR PERIPHERALS AND CHANGE AN EXAMINATION FEE OF $40.00.

THE CUSTOMER UNDERSTANDS THAT ESTIMATED TURN AROUND TIMES FOR SERVICE DO NOT INCLUDE:

•    The day the computer, printer, or network system is picked up
•    The Holidays
•    Time spent waiting for special order parts.
•    Other contracted repairs including Data Recovery

SOFTWARE INSTALLATION

The Customer authorizes Steve's Computer & Web Service, LLC to replace or modify any Internet security software with freely available alternatives and to install an alternative web browser to protect the computer from Internet threats at their discretion and without prior notification. The Customer authorizes the technician(s) providing the service or repair to install anti-virus and any other necessary software on your computer to perform required services. All software will be deleted / uninstalled upon completion of the service


MODIFICATIONS TO TERMS OF SERVICE AND SERVICE

Steve's Computer & Web Service, LLC may change the terms and conditions of the Service from time to time. Upon any such change, Steve's Computer & Web Service, LLC will notify the Customer by posting the changes on its Website. Steve's Computer & Web Service, LLC reserves the right to modify or discontinue the Service with or without notice to Customer. Steve's Computer & Web Service, LLC shall not be liable to Customer or any third party should Steve's Computer & Web Service, LLC exercise its right to modify or discontinue Services. Customers’ use of the Service constitutes an affirmative agreement by Customer to abide and be bound by these Service Terms and its modifications.

CUSTOMER’S RESPONSIBILITIES TO BACK-UP SOFTWARE AND DATA

I, The Customer am aware of the importance of backing up my data and software. The Customer agrees NOT to hold Steve's Computer & Web Service, LLC responsible in any way for the loss or corruption or consequences of the failure to recover any data or software residing on The Customers computer system or data storage device. You understand that in the process of working on your computer equipment, there is a potential for data loss. You agree that you have made the necessary backups of your data so that, in the event of such loss, the data can be restored. Steve's Computer & Web Service, LLC will not be responsible for data loss.

THE CUSTOMER UNDERSTANDS ITEMS LEFT AT STEVE’S COMPUTER & WEB SERVICE, LLC LOCATION LONGER THAN 21 DAYS FROM THE PICK UP DATE BECOMES THE PROPERTY OF STEVE'S COMPUTER & WEB SERVICE, LLC WITHOUT THE CUSTOMERS CONSENT.

PAYMENT POLICIES

  • Signature of your check constitutes acceptance of Steve's Computer & Web Service, LLC Computer, Printer, and Network Terms of Service.
  • Checks must not be post-dated.
  • Steve's Computer and Web Service, LLC accepts cash and checks. All checks must be written out to Steve's Computer and Web Service, LLC
  • Full payment is due upon completion of services, upgrades, or repairs, unless paying by check by mail.
  • For checks paid by mail, checks must be mailed to Steve's Computer & Web Service, LLC within 7 business days of service completion and signature of invoice

IN THE EVENT YOUR CHECK IS RETURNED UNPAID FOR INSUFFICIENT OR UNCOLLECTED FUNDS: We may represent your check electronically or by paper draft.
A service charge for the maximum amount allowed by state law will be assessed, along with any other allowable state fees.

LIMITED WARRANTY FOR LABOR AND REPAIRS/SERVICES

Paid on-site and in-shop labor is warranted for 30-days after completion of work.  Failure of parts purchased from us and installed by us within 30-days from the date of the original service invoice will be replaced and installed by us free of charge.  After 30-days the manufacturers warranty applies.  We will accomplish your warranty repairs or replacement at the place we originally accomplished the work, if you request us to do so.  You must request warranty service before the expiration of this warranty. Failed parts must be returned to us not later than 30-days from the date of the original invoice to qualify for in-house replacement.  Parts warranties after the first 30-days must be handled with the manufacturer directly.

WHAT IS COVERED BY THIS LIMITED WARRANTY?

This limited warranty covers defects in workmanship for your Steve's Computer & Web Service, LLC provided repair/service only for a period of 30-days.

THIS LIMITED WARRANTY EXPRESSLY DOES NOT COVER:

•    Any Software installation, including the operating system and software added to or substantially changed since we provided the original service or labor.
•    Problems that result from external causes such as accident, abuse, misuse, or problems with electrical power or telephone systems.
•    Problems that result from servicing not provided by us.
•    Usage that is not in accordance with product instructions.
•    Failure to follow the product instructions or failure to perform preventive maintenance.
•    Problems caused by using accessories, parts, or components not supplied by us.
•    Labor or services for which we have not received payment (except those accounts on time payment plans that are current).
•    Parts received after 30-days from your original labor invoice

REPAIR AND SERVICE LIMITS

The Customer agrees NOT to hold Steve's Computer & Web Service, LLC or any employee, subcontractor or consultant of Steve's Computer & Web Service, LLC, responsible in any way for the failure or functionality of any and all hardware or software associated with The Customer’s computer, peripherals or data storage device, including any failure that occurs while attempting repair. The Customer accepts ALL RISK associated with any repair or attempted repair or any other action by Steve's Computer & Web Service, LLC and its associated employees and subcontractors on any and all of The Customers computers connected or unconnected by networks.

INDEMNFICATION

Customer agrees to indemnify, defend, and hold harmless Steve's Computer & Web Service, LLC and any employee, subcontractor or consultant of Steve's Computer & Web Service, LLC, against any and all losses, costs, obligations, liabilities, damages, actions, suits, causes of action, claims, demands, liens, encumbrances, security interests, settlements, judgments, and other expenses, (including but not limited to cost of defense, settlement, and reasonable attorneys’ fees) of whatever type or nature, including, but not limited to, damage or destruction to property, injury (including death) to any person or persons, which are asserted against, incurred, imposed upon or suffered by Steve’s Computer & Web Service, LLC by reason of, or arising from: (a) Customer’s breach of this Agreement; (b) Customer’s actual or alleged infringement of any patent, copyright, trademark, trade secret or other property or contract right of any other person; (c) Customer’s actual or alleged failure to promptly pay sums due Steve’s Computer & Web Service, LLC or third parties; (d) Customer’s failure to comply with applicable laws, regulations or ordinances; or (e) the acts or omissions of Customer (or its officers, directors, employees or agents).


I hereby agree to the above terms and authorize Steve's Computer & Web Service, LLC to perform services/repairs as stated in the service estimate. I also agree to the terms and conditions within this Agreement.
